In purchasing this program, Kiliki Pono Wellness Guide, and in exchange for your participation in this health, wellness, and fitness program organized by your trainer, Kristi Hyatt with Boss Up Wellness LLC and/or use of services secured by Kristi Hyatt with Boss Up Wellness LLC, you agree to the following:

Physical exercise can be strenuous and subjects you to risk of serious injury. You are urged to obtain a physical examination from a doctor before participating in any exercise program and/or health and wellness programs. You are urged to go over your exercise programs and/or health and wellness program with your doctor to clear you for activity. Especially if you have blood pressure, diabetes, and/or you are pregnant. You agree that if you engage in any physical exercise or activity, you do so entirely at your own risk. Any recommendation for changes in diet including but not limited to the use of food supplements and/or weight reduction products are entirely your responsibility, and you should consult a physician prior to undergoing any dietary or food supplement changes.

You agree that you are voluntarily participating in these activities and assume all risks of injury, illness or death. This release of liability includes, without limitation, all injuries which may occur as a result of: (a) your participation in any activity or personal training session and (b) instruction, training, supervision, or dietary recommendations by your personal health, wellness, and fitness trainer, Kristi Hyatt with Boss Up Wellness LLC.

You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge your personal health, wellness, and fitness trainer, Kristi Hyatt and Boss Up Wellness LLC, from any and all claims or causes of action, and you agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against your trainer, Kristi Hyatt and Boss Up Wellness LLC, for personal injury, illness, death, or property damage. You have read and have agreed upon the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made. You agree to everything above written in this statement in purchasing this health and wellness program.
